necess\u00e1rios<\/h2>\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Constituem requisitos para a adjudica\u00e7\u00e3o compuls\u00f3ria extrajudicial:<\/p><p><strong>Exist\u00eancia de um compromisso de compra e venda ou instrumento equivalente:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>O interessado (geralmente o comprador) deve comprovar a exist\u00eancia de um compromisso formal que envolva a compra e venda ou outro acordo similar de transfer\u00eancia do im\u00f3vel, como um contrato de promessa de compra e venda, por exemplo.<\/li><\/ul><\/li><\/ul><p><strong>Aus\u00eancia de registro da escritura p\u00fablica no cart\u00f3rio:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>A parte obrigada (geralmente o vendedor) n\u00e3o realizou o registro da escritura p\u00fablica no cart\u00f3rio competente, o que impede a transfer\u00eancia da propriedade do im\u00f3vel para o comprador.<\/li><\/ul><\/li><\/ul><p><strong>Adimplemento do contrato:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>O comprador deve ter cumprido todas as suas obriga\u00e7\u00f5es contratuais, ou seja, pago o pre\u00e7o acordado ou cumprido as condi\u00e7\u00f5es previstas no contrato de compra e venda. N\u00e3o \u00e9 poss\u00edvel pedir a adjudica\u00e7\u00e3o se o comprador n\u00e3o tiver cumprido com sua parte no acordo.<\/li><\/ul><\/li><\/ul><p><strong>Im\u00f3vel registrado em cart\u00f3rio:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>O im\u00f3vel deve estar devidamente registrado no cart\u00f3rio de registro de im\u00f3veis, para que possa ser feito o registro da transfer\u00eancia de propriedade em nome do comprador.<\/li><\/ul><\/li><\/ul><p><strong>Solicita\u00e7\u00e3o feita pelo adquirente (comprador) do im\u00f3vel:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>O comprador do im\u00f3vel pode requerer a adjudica\u00e7\u00e3o diretamente no cart\u00f3rio de registro de im\u00f3veis, sem necessidade de a\u00e7\u00e3o judicial. Ele deve apresentar a documenta\u00e7\u00e3o que comprove a regularidade do contrato e o cumprimento das condi\u00e7\u00f5es.<\/li><\/ul><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-e5f228c elementor-section-full_width elementor-section-height-default elementor-section-height-default\" data-id=\"e5f228c\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-f5ee927\" data-id=\"f5ee927\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2979f67 elementor-widget elementor-widget-heading\" data-id=\"2979f67\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Causas impeditivas<\/h2>\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-4aa10c1 elementor-section-full_width elementor-section-height-default elementor-section-height-default\" data-id=\"4aa10c1\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-0842ad2\" data-id=\"0842ad2\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2eb2b0d elementor-widget elementor-widget-text-editor\" data-id=\"2eb2b0d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Constituem causas impeditivas a adjudica\u00e7\u00e3o compuls\u00f3ria extrajudicial:<\/p><p><strong>Inadimplemento do contrato por parte do comprador:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>Se o comprador n\u00e3o cumpriu com suas obriga\u00e7\u00f5es contratuais, como o pagamento do pre\u00e7o acordado, a adjudica\u00e7\u00e3o n\u00e3o poder\u00e1 ocorrer. O vendedor pode alegar inadimplemento e impedir a adjudica\u00e7\u00e3o.<\/li><\/ul><\/li><\/ul><p><strong>Exist\u00eancia de disputas judiciais sobre a propriedade:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>Caso haja lit\u00edgios judiciais sobre a titularidade ou validade do contrato de compra e venda, o processo de adjudica\u00e7\u00e3o compuls\u00f3ria extrajudicial n\u00e3o poder\u00e1 ser realizado at\u00e9 que a disputa seja resolvida.<\/li><\/ul><\/li><\/ul><p><strong>Im\u00f3vel n\u00e3o registrado ou irregular:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>Se o im\u00f3vel n\u00e3o estiver devidamente registrado no cart\u00f3rio de registro de im\u00f3veis, o cart\u00f3rio n\u00e3o poder\u00e1 proceder com a adjudica\u00e7\u00e3o. O im\u00f3vel deve estar regularizado perante o registro p\u00fablico.<\/li><\/ul><\/li><\/ul><p><strong>Falta de capacidade das partes:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>Se as partes envolvidas no contrato (vendedor ou comprador) forem incapazes, ou seja, menores de idade, interditadas ou incapazes para a pr\u00e1tica do ato, a adjudica\u00e7\u00e3o n\u00e3o poder\u00e1 ser realizada. A parte incapaz deve ser representada ou assistida conforme o caso.<\/li><\/ul><\/li><\/ul><p><strong>Irregularidades no instrumento de compra e venda:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>Se o instrumento de compra e venda n\u00e3o estiver conforme as exig\u00eancias legais (por exemplo, falta de assinatura de uma das partes ou falta de registro), a adjudica\u00e7\u00e3o compuls\u00f3ria pode ser inviabilizada.<\/li><\/ul><\/li><\/ul><p><strong>Exist\u00eancia de hipoteca, penhor ou outros \u00f4nus sobre o im\u00f3vel:<\/strong><\/p><ul><li style=\"list-style-type: none;\"><ul><li>Se o im\u00f3vel estiver gravado com \u00f4nus, como hipotecas ou penhoras, o cart\u00f3rio pode exigir que esses \u00f4nus sejam resolvidos antes da adjudica\u00e7\u00e3o, ou pode ser necess\u00e1rio que o comprador se responsabilize por tais encargos.<\/li><\/ul><\/li><\/ul><p>Em resumo, a adjudica\u00e7\u00e3o compuls\u00f3ria extrajudicial de im\u00f3vel ocorre de maneira simplificada, sem a necessidade de a\u00e7\u00e3o judicial, desde que o comprador tenha cumprido as obriga\u00e7\u00f5es do contrato e o vendedor n\u00e3o tenha registrado a escritura do im\u00f3vel, desde que n\u00e3o haja impedimentos legais ou contratuais para tanto.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element
