escritura de compra e venda no cart\u00f3rio de registro de im\u00f3veis. O juiz determina, ap\u00f3s analisar o caso, que a transfer\u00eancia de propriedade deve ser realizada, independentemente da vontade do vendedor. Isso ocorre, por exemplo, em casos em que o vendedor n\u00e3o cumpre o contrato, mas o comprador j\u00e1 pagou o pre\u00e7o acordado.<\/p><p><span style=\"font-size: 1.375rem;\">Adjudica\u00e7\u00e3o compuls\u00f3ria extrajudicial<\/span><\/p><p>A adjudica\u00e7\u00e3o extrajudicial ocorre fora do \u00e2mbito judicial, diretamente no cart\u00f3rio de registro de im\u00f3veis. Ela \u00e9 mais simples e r\u00e1pida, pois n\u00e3o envolve o judici\u00e1rio, e \u00e9 baseada no cumprimento integral do contrato de compra e venda. No entanto, Maria n\u00e3o compareceu ao cart\u00f3rio de registro de im\u00f3veis para realizar a escritura p\u00fablica e formalizar a transfer\u00eancia da propriedade. Apesar das tentativas de resolu\u00e7\u00e3o amig\u00e1vel, Maria se recusa a registrar a venda do im\u00f3vel em nome de Jo\u00e3o.<\/p><p>Como Jo\u00e3o j\u00e1 cumpriu sua parte no contrato e Maria n\u00e3o executou a sua obriga\u00e7\u00e3o de registrar a venda, Jo\u00e3o decide recorrer \u00e0 adjudica\u00e7\u00e3o compuls\u00f3ria extrajudicial. Ele apresenta todos os documentos necess\u00e1rios (como o contrato de compra e venda, comprovantes de pagamento, entre outros) no cart\u00f3rio de registro de im\u00f3veis onde o im\u00f3vel est\u00e1 registrado.<\/p><p>Ap\u00f3s an\u00e1lise, o cart\u00f3rio verifica que Jo\u00e3o cumpriu todas as obriga\u00e7\u00f5es do contrato, e que o im\u00f3vel est\u00e1 regular e n\u00e3o h\u00e1 nenhum impedimento legal para a transfer\u00eancia de propriedade.
